Important Information about Flooding for Insurers
Due to the State of Emergency and the historic flooding in parts of Louisiana, the Commissioner of Insurance issued Emergency Rules 27, 28 and 30 which retroactively suspend statutory provisions of the Insurance Code concerning cancellations, terminations and nonrenewals of insurance policies.
Certificate of Destruction for Flooded Cars
Following the federal declaration of disaster for Louisiana, the Department of Insurance issued a reminder to insurance companies regarding Certificate of Destruction title requirements. In accordance with La. R.S.
32:707.3, when, as a result of an insurance settlement, a motor vehicle is determined to be a total loss due to water damage, Louisiana law requires that the insurance company that acquires ownership of the vehicle shall within 30 days from the settlement of the claim, send the certificate of title to the Office of Motor Vehicles along with an application for a Certificate of Destruction.
