Title License Qualifications
Act 310 of the 2020 Regular Session of the Louisiana Legislature set forth certain requirements for obtaining and maintaining a producer license for the line of Title Insurance. These requirements were further modified by Act 264 of the 2022 Regular Session of the Louisiana Legislature. In order to be issued a producer license for title, an applicant must demonstrate that they meet these requirements.
Initial Individual Title Insurance Producer:
- Be at least 18 years of age.
- Be a resident of Louisiana or a full- time employee of a resident licensed title agency producer.
- Hold a high school diploma or its equivalent or a certificate, diploma or degree from an accredited postsecondary educational institution.
- Pass the title license examination.
Resident applicants must provide proof of a high school diploma or equivalent with the license application and must be uploaded to the NIPR Attachment Warehouse at the time the application is filed via NIPR.
Nonresident applicants who are licensed for title in their home state are exempt from exam requirements but must verify full-time employment with a Louisiana resident agency producer by filing an Affidavit for Non-Resident Individual Title Producer (Application for New License) in conjunction with the license application and must be uploaded to the NIPR Attachment Warehouse at the time the license application is filed via NIPR. In addition to the completed Affidavit, proof of high school diploma or postsecondary diploma, or its equivalent must be uploaded to the NIPR Attachment Warehouse at the time of application.
Full-time employee means an individual with an employment or independent contractor relationship with an agency producer in which the individual provides full-time availability to the agency producer and whose employment or contract relationship is exclusive to the agency producer and the agency producer’s affiliated businesses.
Initial Title Insurance Producer Agency:
- Have a principal place of business physically located in Louisiana.
- Designate at least one resident individual licensed for title insurance in Louisiana as responsible for the entity’s compliance.
- Maintain an appointment to represent a title insurer.
- The entity and the designated individual must not have had a producer license or its equivalent suspended, revoked or refused in any other state, province, district or territory.
The designated resident individual producer must have a degree of affiliation with the entity, such as an ownership interest or a roll as an officer, director, or other relationship sufficient to cause or influence the entity's compliance with Louisiana insurance law, rules and regulations.
A principal place of business is defined as a place from which the agencies officers and other principals direct, control and coordinate the entity's business activities.
To verify compliance with the above requirements, a resident title agency applicant must file an Affidavit for Resident Agency Title Producer (Application for New License) in conjunction with the license application. This document must be uploaded to the NIPR Attachment Warehouse at the time the initial license application is filed via NIPR.
Requirements for License Renewal:
Resident individual title licensees are required to comply with continuing education requirements in order to renew their license.
Non-resident title producers must file Affidavit for Non-Resident Individual Title Producer (Renewal Form for Current License Holder) in conjunction with a license renewal application to demonstrate continued compliance with title licensing requirements.
Resident and non-resident title agencies must file Affidavit for Resident Agency Title Producer (Renewal Form for Current License Holder) in conjunction with a license renewal application to demonstrate continued compliance with title licensing requirements.
